1. Agreement
These Customer Terms supplement the TindaNation General Terms of Use and apply whenever you browse, place, pay for, receive, cancel, dispute, or otherwise participate in an Order as a Customer.
By registering, selecting an acceptance control, or continuing to access or use the Platform after these Customer Terms are presented to you, you acknowledge and agree to be bound by them. Continued use constitutes ongoing acceptance of the then-current Customer Terms, subject to applicable notice, consent, and mandatory legal requirements.
2. Customer Account and Information
- Provide a reachable mobile number and complete, accurate profile and delivery information.
- Keep saved addresses, City, Barangay, landmarks, map pin, and contact instructions accurate enough for delivery.
- Do not place fraudulent, prank, abusive, or intentionally unpayable Orders.
- If another person will receive an Order, ensure that person is authorized and able to comply with any lawful identification or age-verification requirement.
3. Merchant and Service-Area Rules
TindaNation may show Merchants based on the Customer’s selected City or service area. Availability depends on Merchant status, operating hours, inventory, Delivery Operator coverage, Rider availability, technical conditions, and other legitimate operational factors.
4. One-Merchant-Per-Order Rule
Each TindaNation Order is limited to one Merchant. Adding items from another Merchant may require you to clear the existing cart before proceeding. Changing to an address in another City may invalidate or clear the cart because Merchant and Delivery Operator availability can change by service area.
5. Delivery Operator Selection and Delivery Fees
Where the Platform provides a choice, you may select a Delivery Operator serving your Barangay. The applicable delivery fee and other disclosed charges will be shown before you confirm the Order. Operator availability, service boundaries, and fees may vary by location and time.
6. Prices, Taxes, Substitutions, and Price Changes
- Merchants are responsible for accurate product prices and required product information. The total payable amount will be shown before confirmation, subject only to a lawful and disclosed adjustment process.
- A Merchant or Rider may not impose a hidden charge outside the Platform’s authorized process.
- If an actual store price, weight-based price, or availability issue requires a change after ordering, the change must be communicated through an authorized TindaNation workflow and must be accepted by you before you are charged the higher amount, unless applicable law provides otherwise.
- Product substitutions should not be made without your authorization when the substitution materially changes the item, price, quantity, allergen profile, or other important characteristic.
7. Payment
The payment method available for an Order will be displayed in the Platform. For cash-on-delivery or similar arrangements, you must have the agreed amount available when delivery is completed. Where a Rider or Operator advances payment to a Merchant under the displayed Order arrangement, you remain responsible for reimbursing the amount properly due, subject to valid cancellation, refund, or dispute rights.
8. Cancellation
Cancellation rights depend on the Order stage, product type, whether goods are perishable, whether a Rider/Operator has already paid for or taken possession of the goods, and applicable law. The detailed rules are in the Cancellation, Refund and Order Dispute Policy. You must not use cancellation to avoid payment for goods already properly purchased, transported, or delivered for you.
9. Delivery and Receipt
- Be reasonably available at the delivery location and keep your phone reachable during an active delivery.
- Provide safe and lawful access instructions. Riders are not required to enter unsafe, prohibited, or inaccessible areas.
- Check obvious quantity or condition issues promptly when practical and report problems through the Platform.
- Proof of delivery may include status records, timestamps, photos where appropriate, receipts, signatures/acknowledgements, or other permitted evidence.
10. Restricted and Age-Controlled Goods
If TindaNation permits a regulated or age-restricted category, you must satisfy the legal age and identification requirements. A Rider or Merchant may refuse handover where required identification is missing, invalid, inconsistent, or shows that the recipient is below the lawful age. Attempting to evade age verification or order prohibited goods may result in cancellation, suspension, reporting, and other lawful action.
11. Food, Allergies, and Product Information
Merchants are responsible for product descriptions and food preparation. If you have allergies, dietary restrictions, or other safety concerns, review available information and contact the Merchant when necessary. TindaNation does not independently verify every ingredient or allergen statement, but it may require Merchants to provide information and may act on safety reports as required by law.
12. Returns, Refunds, and Remedies
Defective, nonconforming, missing, unsafe, materially misdescribed, or otherwise legally deficient goods may give rise to repair, replacement, refund, return, or other remedies under applicable law. A “no return, no exchange” statement does not override mandatory consumer rights. Follow the Cancellation, Refund and Order Dispute Policy for reporting and evidence requirements.
13. Customer Conduct
- Treat Merchants, Operators, Riders, and support personnel respectfully.
- Do not threaten, harass, discriminate against, assault, stalk, exploit, or intentionally endanger another person.
- Do not ask a Rider to transport illegal goods, perform an illegal act, falsify proof, bypass the Platform, or violate traffic/safety rules.
- Do not misuse internal chat or contact details for unrelated purposes after an Order.
14. Account Enforcement
TindaNation may restrict or terminate Customer access for fraud, abusive conduct, repeated intentional non-payment, unlawful orders, age-verification evasion, misuse of personal data, safety threats, or serious/repeated violations, subject to applicable law and the Complaints Policy.
