Prohibited and Restricted Products Policy

1. Purpose

TindaNation prohibits illegal and unsafe commerce and restricts categories that require permits, product registration, age controls, tax compliance, special handling, or other legal conditions. This Policy is non-exhaustive. A product may be removed even if it is not specifically named here when law, a regulator, safety evidence, or TindaNation policy requires removal.

2. General Rule for Regulated Goods

A Merchant may not list a regulated good unless TindaNation has enabled the category and the Merchant has provided the required permit/licence/product information and agreed to the applicable sale procedures and limitations. TindaNation may require re-verification and may suspend a category while regulatory status is uncertain.

3. Prohibited Categories

• Illegal, stolen, smuggled, counterfeit, pirated, or unlawfully imported goods.
• Dangerous drugs, controlled substances, illegal narcotics, or drug paraphernalia where sale/possession is prohibited.
• Firearms, ammunition, explosives, improvised explosive materials, and weapons that TindaNation designates as prohibited or whose online sale/delivery is unlawful or requires controls TindaNation has not implemented.
• Counterfeit or falsified medicines, health products, permits, identity documents, government documents, certificates, tickets, or financial instruments.
• Human remains, human organs/body parts, or biological materials whose trade is prohibited or not lawfully authorized.
• Protected wildlife, illegally harvested forest products, prohibited plants/animals, or other environmental contraband.
• Goods that infringe intellectual property rights or are unlawfully copied/reproduced.
• Items subject to a government takedown, recall, ban, seizure order, or credible imminent safety prohibition.
• Any product or service whose sale, advertisement, possession, transport, or delivery would violate applicable national or local law.

4. Restricted / Verification-Required Categories

• Food, processed food, food supplements, beverages, cosmetics, household/urban hazardous substances, medical devices, medicines, and other FDA-regulated health products.
• Tobacco products, heated tobacco, vaporized nicotine/non-nicotine products, novel tobacco products, devices, and refills.
• Alcoholic beverages.
• Electrical appliances, consumer electronics, construction materials, LPG products, automotive safety products, helmets, and other products subject to Philippine standards/certification.
• Pesticides, agricultural chemicals, fertilizers, plants, planting materials, animal products, wildlife-related goods, fisheries products, forestry products, and other agriculture/environment-regulated goods.
• Fireworks, compressed gases, hazardous chemicals, flammables, or dangerous goods that may be legally sold only under specific licences and handling rules.
• Any category appearing in the DTI E-Commerce Philippine Trustmark non-exhaustive list of prohibited or regulated products, or subsequent official updates.

5. Medicines and Health Products

TindaNation should not enable prescription medicines, controlled medicines, or other health-product categories unless the Platform has verified the legally required establishment/product authorizations and has implemented the specific online sale, dispensing, storage, prescription, and delivery controls required by the FDA and other applicable law. TindaNation may prohibit these categories completely as a risk-control measure.

6. Tobacco and Vapor Products

If TindaNation enables tobacco or vapor categories, the Merchant must satisfy all applicable DTI/SEC business registration, BIR/tax-stamp/floor-price, product, health-warning, advertising, age-verification, and online-sale requirements. Vaporized nicotine/non-nicotine and novel tobacco products may not be sold or delivered to a person below eighteen (18) years old. Appropriate online age controls and valid government-issued ID verification at delivery must be used where required.

7. Alcohol

Alcohol may be listed only where the Merchant has all applicable licences/permits and TindaNation has enabled an age-verification workflow. The Customer/recipient must satisfy the minimum age and identification requirements applicable to the product and location. Local ordinances or product-specific laws may impose stricter rules. A Rider must refuse handover when lawful age/identity requirements are not satisfied.

8. Food Safety

Food must be lawfully produced/prepared, fit for sale, protected from contamination/spoilage, properly packaged, and compliant with applicable food-safety, sanitation, licensing, and labelling rules. TindaNation may remove or suspend a Merchant following credible food-safety complaints while investigation is pending.

9. Age Verification and Refusal

• Age-restricted listings should not be shown or sold without the age controls required by applicable law.
• The recipient may be required to present a valid government-issued photo ID showing date of birth.
• If age cannot be verified, the Rider must refuse delivery and follow the return/refund process.
• Customers must not ask another person to defeat age verification or use false identification.
• Merchants/Operators/Riders must report suspected unlawful age-restricted transactions through TindaNation.

10. Merchant Documentation

TindaNation may request business registration, permit/licence numbers, product registration/certification, tax/fiscal compliance evidence, supplier/source records, invoices, authorization letters, and other documents reasonably necessary to confirm lawful sale. Failure to provide adequate evidence may result in listing removal or account suspension.

11. Takedown and Reporting

TindaNation may remove, disable, quarantine, suspend, or preserve records concerning suspected prohibited, unsafe, dangerous, infringing, or unlawfully offered products. TindaNation may report information to competent authorities when required by law, pursuant to lawful process, or when reasonably necessary to address serious safety or suspected crime.

12. Policy Updates

Because regulated-product rules change, TindaNation may update this Policy and category requirements. Merchants remain responsible for complying with the current law even before the Platform’s written policy is updated.
